Conditions of Use

Please read these conditions carefully before using YAR e-commerce. By placing an order, you agree to YAR’s privacy notice and conditions of use.

We offer a wide range of YAR products, and sometimes additional terms may apply. When you use YAR e-commerce (for example Your Profile or mobile YAR site), you will also be bound by the terms, guidelines and conditions applicable to that YAR e-commerce site ("Service Terms"). If these Conditions of Use differ from the Service Terms, those Service Terms will prevail.

Privacy

Please review our Cookies Policy, which also govern your use of YAR e-commerce, to understand our practices.

Electronic Communication

When you use YAR e-commerce or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, text, in-app push notices or by posting e-mail messages or communications on the website or through the others options. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing unless mandatory applicable laws specifically require a different form of communication.

Copyright, author’s rights and database rights

All content included in or made available through the YAR e-commerce site, such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations is the property of YAR or its content suppliers and is by right laws. The compilation of all content included in or made available through the YAR e-commerce is the exclusive property of YAR and is protected by international copyright and database right laws.

You may not extract and/or re-utilize parts of the content of YAR e-commerce without our express written consent. In particular, you may not utilize any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilization any substantial parts of the content of YAR e-commerce, without our express written consent. You may also not create and/or publish your own database that features substantial parts of YAR e-commerce (e.g. our prices and product listings) without our express written consent.

User Agreement

The Users agrees, in general, to use the shop, purchase the products and use each of the services of the shop diligently, in accordance with the law, morality, public order and the provisions of General Conditions also should refrain from using it in any way that may impede, harm or impair the normal functioning and enjoyment of the shop by Users and can injure or cause damage to property and rights of YAR, its suppliers, users or in general any third party.

Intellectual Properties

The user acknowledges that all elements of the store and each of the products, information and material contained therein, trademarks, structure, selection, arrangement and presentation of its contents and the computer programs used in relationship with them are protected by intellectual property rights and industrial owned by YAR.

The user should abstain or manipulate any technical device set by YAR into the shop site.

Trademark

YAR graphics, logos, page headers, button icons, scripts, and service names included in or made available through YAR e-commerce site are trademarks or trade dress of YAR. YAR’s trademarks and trade dress may not be used in connection with any product or service that is not YAR’s, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits YAR.

No YAR e-commerce site, nor any part of any YAR e-commerce, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout, or form) of YAR without our express written consent. You may not use any meta tags or any other "hidden text" utilizing YAR’s names or trademarks without our express written consent.

You may not misuse the YAR e-commerce. You may use the YAR e-commerce only as permitted by law.

Alterations to service or amendments to the conditions of use

We reserve the right to make changes to YAR e-commerce, policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the YAR e-commerce. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Children

We do not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18 you may use the YAR e-commerce only with the involvement of a parent or guardian.

Conditions of Sale

Please read these Conditions of Sale carefully before placing an order with YAR. By placing an order with YAR, you signify your agreement to be bound by these conditions.

If these Conditions of Sale are inconsistent with the Service Terms, those Service Terms will prevail.

Our Contract

When you place an order to purchase a product from YAR e-commerce the order confirmation is acknowledgment that we have received your order, and does not confirm acceptance of your offer to buy the product.

We only accept your offer and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send an e-mail or post a message on the Message Centre of the website confirming to you that we've dispatched the product to you.

Your contract is with YAR. without affecting your right of cancellation set out in the section below; you can cancel your order for a product at no cost any time before we send the Dispatch Confirmation relating to that product.

You consent to receive sales invoices electronically. For further information about electronic invoices and instructions on how to receive a paper copy please refer to our help pages.

Please note that we sell products only in quantities which correspond to the typical needs of an average household. This applies both to the number of products ordered within a single order and the placing of several orders for the same product where the individual orders comprise a quantity typical for a normal household.

Account & Passwords

If you use YAR e-commerce, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and devices, and to the extent permitted by applicable law, you agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you find some suspicious account access.

If you have any reason to believe that your password is being used in an unauthorized manner, you are responsible to inform us as soon as possible.

Applicable Law

These conditions shall be governed by Australian law. Any dispute arising from the interpretation or execution that may arise regarding the validity, interpretation, fulfilment or termination of this contract will bring under the Jurisdiction of the Courts of the City of Byron Bay, waiving the capacity that may apply to User, unless applicable law so permits.

young and restless. (yar) provides products to you when you visit or shop at youngandrestless.com.au (the "website"). YAR sells the products to you subject to the conditions set out on this page. The Animals Observatory is the trading name for YAR.

Prices and Products

YAR e-commerce reserves the right to decide at any time the products that are offered to users through the store. In particular, YAR e-commerce may at any time add new products to those already offered or included in the store, these new products will be governed by who is willing to these Terms. If prices are visible on the web, in any case are contractual and/or may be subject to some type of promotion. YAR reserves the right to refuse an offer customer if a price is displayed with a wrong result of a typographical error or technology. In addition, YAR reserves the right to stop providing or facilitating the access and use at any time and without notice of any of the various types of products offered in the store.

Products included in the shop will correspond as faithfully as possible using technology to display products actually offered. The characteristics of the products and their prices appear in the shop. The prices in the shop are in Euros unless indicated otherwise.

Preorder Items

Please choose carefully when placing a PREORDER. The expected shipping date for Pre-Order Products will be clearly noted on each Product page, subject to reasonable delays in manufacturing and/or delivery. Such date is only an estimate, is subject to change, and Company does not represent or warrant that it will be able to ship the Product by the estimated date. Once you place your order, your order is final, non­cancelable and non­refundable to the applicable terms of sale.

Our Liability

We will do our utmost to ensure that availability of the YAR e-commerce will be uninterrupted and that transmission will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to YAR e-commerce may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

YAR e-commerce will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using the YAR e-commerce.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

Customs

When ordering products from YAR e-commerce for delivery outside of AUS you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from YAR e-commerce, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

Children
